Terms of Use
These terms are an agreement between you and TODO: full legal name or company, TODO: postal address, Türkiye ("we"), for the Wouldy app and service. By using Wouldy you accept them. If you don't, please don't use it. Our Privacy Policy explains how we handle data.
These terms are used instead of Apple's standard licence agreement. Apple is not a party to them and is not responsible for Wouldy or its content; see "Apple" below.
1. What Wouldy is
Wouldy lets you describe a fictional character in an interview and ask what that character would do. AI models write the character's analysis and estimate the answers as probabilities. It is entertainment.
2. Who can use it
You must be at least 13, and old enough in your country to agree to online services without a parent (up to 16 in some EU countries). If you use Wouldy for an organisation, you confirm you may accept these terms for it.
3. Fictional characters only: the content rules
You may not use Wouldy to:
- describe a real, identifiable person, including yourself, a friend, a colleague, an ex or a public figure, or to predict what a real person would do;
- enter health, religious, political, sexual-life, biometric or criminal details about anyone;
- create sexual content involving minors, or any content that sexualises a character described as under 18;
- harass, threaten, defame or discriminate against anyone, or plan harm to yourself or others;
- break the law, infringe others' rights, or try to get around safety filters or usage limits;
- scrape, reverse-engineer, overload or resell the service, or use it to train other AI models.
We may refuse requests, remove content and suspend accounts that break these rules. Report a problem to support@example.com; we aim to respond within 24 hours.
4. AI-generated content
- Analyses and answers are produced automatically by AI models from third-party providers. They are estimates about a fictional character, can be wrong, inconsistent or unexpected, and the models may refuse some requests.
- They are not facts, advice or predictions about any real person, and must not be used for decisions about people (hiring, dating, lending, health or legal matters).
- If you share a result, keep the "AI estimate" label and don't present it as a real person's view.
5. Your account
You can use Wouldy with an account created on your device or with Sign in with Apple. Keep your device secure; you are responsible for what is done with your account. You can delete your account at any time in the app; see the Privacy Policy for what that removes.
6. Your content
What you write stays yours. You give us a worldwide, non-exclusive, royalty-free licence to store, process and transmit it, including to our AI providers, only to run Wouldy for you, and to keep it for as long as the Privacy Policy says. You confirm you have the right to enter it and that it follows section 3.
7. Limits, prices and subscriptions
AI processing costs money, so free use has daily limits for characters and questions. TODO: describe the free quota and any subscription once decided. Subscriptions are sold and billed by Apple, renew automatically until cancelled in your Apple ID settings, and refunds are handled by Apple under its terms. We may change limits and features; changes to a paid plan apply from the next billing period.
8. Changes and availability
We may update, suspend or end the service, or features of it. If we end Wouldy, we will give at least 30 days' notice in the app so you can export your characters. We may change these terms; we will post the new version here and tell you in the app before material changes apply.
9. No warranty
Wouldy is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, including fitness for a particular purpose, accuracy of AI output, or uninterrupted service.
10. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental or consequential damages, lost data or profits, or for decisions made using AI output. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and USD 50. Nothing here limits liability that cannot be limited by law, including for intent, gross negligence, or death and personal injury, or your statutory rights as a consumer.
11. Ending the agreement
You may stop using Wouldy and delete your account at any time. We may suspend or end your access if you break these terms, with notice where reasonable. Sections 4, 6 (for content we may keep by law), 9, 10 and 12 survive.
12. Law and disputes
TODO: governing law and venue, to be set with counsel. If you are a consumer in the EU or UK, you keep the protection of the mandatory laws of your country and may bring claims in its courts. EU consumers can also use the EU online dispute resolution information at the European Commission's website.
13. Apple
If you downloaded Wouldy from the App Store: these terms are between you and us, not Apple; Apple has no obligation to provide maintenance or support; to the extent permitted by law Apple has no warranty obligation, and for any failure of the app to conform to a warranty you may notify Apple for a refund of the purchase price, if any; Apple is not responsible for claims about the app (product liability, legal or regulatory compliance, consumer protection, intellectual property); you confirm you are not in a country under a US government embargo or on a US prohibited-party list; and Apple and its subsidiaries are third-party beneficiaries who may enforce these terms against you.
